An Overview of the Constitutional Right to Clean Environment and Sustainable Development
Abstract
This paper looks at the salient provisions of the South African Constitution that seeks to highlights the importance of everyone’s right to clean and sustainable environment. Against this backdrop, the paper argues that for this right to be enjoyed there is need to ensure that the environment is protected. For purposes of a robust overview, the paper relied on the decisions of the courts and these were used to assess whether the rights to clean environment have been violated and consequences thereof.Downloads
